These Terms & Conditions ("Terms") are a legal agreement between you and OrigAfric Softwares ("OrigAfric", "we", "us", or "our"), the provider of the MkulimaOS farm management platform (the "Service"). By creating an account or continuing to use the Service, you agree to be bound by these Terms.
You confirm that you are at least 18 years old and, if you are using the Service on behalf of an organisation, that you have authority to bind that organisation to these Terms.
MkulimaOS is a software-as-a-service platform that helps farms manage livestock, crops, inventory, labour, equipment, finance, and compliance workflows. We may add, change, or remove features from time to time.
You are responsible for keeping your login credentials confidential and for all activity that happens under your account. You must provide accurate information and keep it up to date.
You agree not to misuse the Service. In particular, you must not:
OrigAfric Softwares (and its licensors) owns all rights, title, and interest in and to the Service, including all software, documentation, and branding. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan.
You retain ownership of the data you upload. You grant us a limited licence to host and process that data solely to provide the Service to you.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payments, billing, taxes, currency conversion, cancellations, and refund mechanics are governed by Paddle's Checkout Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled.
Refund requests are handled in accordance with our Refund Policy.
We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or secure at all times. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
We may suspend or terminate your access if you materially breach these Terms, fail to pay for the Service, pose a security or fraud risk, or repeatedly violate our policies. You may cancel your subscription at any time through the Paddle customer portal.
On termination, you will be given a reasonable period to export your data before it is deleted in line with our Privacy Notice.
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the fees you paid to us in the twelve (12) months before the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law (such as fraud, death, or personal injury caused by our negligence).
You agree to indemnify OrigAfric Softwares against claims arising from your content, your use of the Service in breach of these Terms, or your unlawful conduct.
We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the Republic of Kenya. The courts of Kenya have exclusive jurisdiction over any dispute arising out of or in connection with them, subject to any mandatory consumer-protection rules of your country of residence.
